In an online eavesdropping case with potentially profound implications, a federal appeals court ruled it was acceptable for a company that offered e-mail service to surreptitiously track its subscribers’ messages

Essentially, because the mail was ‘at rest’ and not read off the wire the wire tapping legislation does not apply. What this means is that any commercial ISP may read your mail as it sits on their servers… The case referred to above was about buying second hand books. My guess is that it won’t be next time…
